All except #5 are solved. I thinks it's a little far out. I will just goa ahead and post the answer.

In cryptic clues. "the," "a," punctuation marks, etc., can be:
- included to mean something
- excluded if extraneous to the solution
- included so the solver moves away from the correct solution.
It's the setter's choice. I excluded "the" in this clue to actually make it easier to solve the clue since the word "the" is extraneous to the solution ("Spanish" indicates a Spanish word in the answer, and so why telegraph what that word is?) .
