If BJP gets 220+ seats by itself then no force is stopping Modi from becoming PM. And a new Govt can always re-define the terms of any commission as well as boot him out and it is well within the executive realm that the judiciary can do nothing. Modi is not the kind to be 'embarassed' with this anyways. Cong is better off concentrating how to restrict BJP to under 200 if they want to keep Modi out.

If the appointee is a sitting judge, his boss (CJI of Allahabad HC or SC) has to clear his name. They can reject the appointment without giving reasons.
In the end, this move will backfire on CONmen. Even Muslims will be sick of the recent CONgames.
