This is bizaare.

A normal person would be very careful not to get into trouble when he visits a foreign country.

I guess he felt too comfortable in India.

Dr. Khalil Chishty is almost 80 years old now. He received his PhD from University of Edinburgh, Scotland in 1968 in Public Health Virology. He had an illustrious career as a professor and head of department of virology and microbiology at Karachi University. He retired from his service in the late 1980s and wanted to enjoy his retirement with his family and grandchildren in his new house at Karachi. But destiny scripted something else for Dr. Chishty.

In 1992, Dr. Khalil Chishty came to India to visit his ailing mother who was staying with his younger brother at Ajmer. During his visit, a longstanding feud between his brother and his distant paternal relatives took an ugly turn. Two of his nephews were injured with knives during the quarrel, and his third nephew fearing the worst went and came back with a gun. He was confronted by one of the attackers who tried to grab the gun from him. As the two struggled for the gun, it accidentally fired and hit another attacker, who succumbed to his injuries. Dr. Chishty was clearly at a wrong place at a wrong time. He was implicated in the criminal act by the opposing party. His passport was confiscated and he was sent to jail. Overtime, everyone including Dr. Chishty got bail.

As years passed, both the parties (Dr. Chishty’s nephews and his relatives) lost interest in bringing the case to a close and the courts too were happy delaying hearings on a regular basis. The 19 years of the trial became Dr. Khalil Chishty’s nightmarish retirement. Instead of enjoying his books, his children’s and grandchildren’s weddings, he was forced to live in exile. His wife who had hearing problems for a long time has lost almost all of her hearing…as a result the solace of talking to his wife over phone too has been lost now. As if these travails were not enough, he fell from his bed last year and suffered a hip fracture and then a heart attack.

After more than 19 years, the Ajmer court gave the verdict awarding life imprisonment to Dr. Khalil Chishty and his nephews. The trial court was not impressed with Dr. Chishty’s appeal that he was only an onlooker and played no part in the offence. When a petition was moved for bail in the High Court of Rajastan, the learned judge refused bail to Dr. Chishty while he granted it to his two nephews who were the co-convicts. The High Court judge made a comment (which was not recorded in the bail order) that, “While I appreciate that he never violated the law in the 19 years of being on bail in India, but since he is a Pakistani we cannot show leniency.”

Dr. Chishty, who is frail and became disabled due to hip injury, is spending his days in the Ajmer jail hospital. His family members and human rights activists in both countries have appealed to the Governor of Rajasthan, Home Minister of India and President of India to use their discretionary powers to release and repatriate him to Pakistan on humanitarian grounds. It would be truly a benevolent act by the Indian government if he is allowed to go to his country to spend his remaining days in peace with his family members.

Indian judiciary did not do a good job - heck it never did - of establishing his role clearly. when a case takes 19 years, memories, witnesses, and even some of the accused are lost.

At least he was on bail and outside for 19 years. I think it is good they released him - since it does not look certain that he was the killer. Probably, all the nephews on the other side banded together and implicated this "outsider"

Somebody has to do some serious shyt on the corrupt Indian judiciary - it is high time Baba Ramdev start another fast unto death along with his partner Digvijay Singh.
