"This acquiescence may well be seen as a signal of the court's intended resolution of that question," Thomas wrote in an opinion that was joined by Justice Antonin Scalia. "This is not the proper way" for the court to carry out its role under the Constitution, he wrote, "and, it is indecorous for this court to pretend that it is."

what's indecorous thomas is for a boss to put pubic hair on an employee's ask an employee as to who put pubic hair on his coke can.

>>>Thomas's strange behavior aside, this is an inconsistent position the SC is taking. If it is the ultimate arbiter on the issue, I don't know why it won't take it up and rule on it. The states' position that the local court rulings on lifting of the ban be stayed till the SC rules on it seems logical. In theory, the SC could still uphold the ban as constitutional, in which case that would reverse the lower court rulings.

maybe, but pubic-hair-thomas (aka mayir pudungi thomas) has no credibility. i am more likely to take the other eight justices seriously.
