Hi I may have asked this before but am unable to find the old post.


How is it possible to work for a US based company while living in India? Lets say a US based company likes my CV but either (1) Cant do an H1 or (2) H1 not possible as they have run out of H1s for year 2012 -is that true though, is it still possible to get an H1 if one wants to start working right now.

In the above 2 scenarios, can I suggest to them that we can work from home, and get paid in dollars? It should suit them as they will have to pay us much less CTC (no health insurance, lower cost of living etc) if I work for them from home. And then I can visit them on another visa (may be a tourist visa or something) as and when the project demands. Please give your suggestions. TIA

First, do you have a US company that is willing to interview you? At least on the telephone? Second, if the company has an office in India, the best bet is to go and approach them in India. These days almost every company has an office or susidiary in India. Remember that the days of shifting "everything" to India (aka outsourcing) are gone for good. Outsourcing still may happen but not the level it once did in early 2000s. And ask yourself the question - "Why should a US Company hire me without even seeing my face?" What is the answer? If your answer is like "I got noble prize for physics, I am an expert neurosurgeon who can do it minimally invasive, I cure heart disease in 3 months," etc then you "may" be able to get an interview. :-)

Try to read the rules of visa. You stated that you can visit them on another visa (Tourist or something). A tourist is not supposed to work. If he does, both the tourist and company will have penalties.

It appears that your main aim is to come to USA to get "dollars" from your post. The easiest way is to find a recruiter in India who can get you a job and a H1B to come here later. The naunces of how good is a recruiter and what his business is, etc., need to be worked out on your end. It is obviously your homework to do.

Last, do not make assumptions like "It should suit them as they will have to pay us much less CTC (no health insurance, lower cost of living etc) if I work for them from home," because what suits an employer will be solely decided by the employer, not the employee. Also remember anyone who is offering you a job is smarter than you are. That is probably a reason why he is an employer and you are an employee.

I will ask some other clarifications later - but what struck my attention was - Also remember anyone who is offering you a job is smarter than you are.
That is probably a reason why he is an employer and you are an employee.
I don't think employer is smarter than the employee. The employer can run his business only because of the employee. If there is no employee, what will the employer do :)Any ideas on how to find out if H1 visas are available for now?

Thanks, but to clarify, companies hire people from abroad all the time that is how they come on H1 B visa. And I am not talking about those people who go to the US for their MS and then get hired there, but I am talking about people who are directly hired from India. I am sure all those overseas candidates are directly hired and interviewed over Skype.

As for your second question, did you mean to say that outsourcing will stop due to the recent change in government? I doubt if all outsourcing will stop. I do believe it is indeed very lucrative for an employer to hire me with much less CTC - he may have to pay be as low as 5 times less that what is paid to an employee living in the US.
