i've been reading sentiments like this and hearing sentiments like this from friends and relatives more and more the last week. death sentence for rape? do you all really think this is appropriate and proportional punishment?

The death penalty for the act of rape that has been proven in the court of law will deter at least some potential rapists though it will not solve the problem entirely.

Regarding proportionality, I think it is.

The state government has also issued orders to put in place close-circuit television (CCTV) sets in all public buildings to identify those who trouble women, she said. Police personnel in plainclothes would be deployed at market places and colleges to ensure the safety of women.

does she think TN state need all this, based on reports, or is she going for an overkill?

i don't agree and the SCOTUS agrees with me. kennedy v louisiana. i want to preemptively state that i will not be participating in discussions that involve questions like "if kitty dukakis was.... would you still not support the death penalty?".

I am surprised at how you guys jump to the conclusion of death sentence for all rapists. Just like the death sentence is not given to any and all murderers, the death sentence will be clearly handed down in cases like the delhi girl - gang rapes and physical torture, etc. Trying to be all too humanistic towards these barbarians is a wrong message.

Tell me...do you know of any law that has not been abused or misused in India? Please tell us. Attempting to come up with fool-proof rape laws is a blatant excuse to avoid the problem - which equals supporting rapists.

The child in that particular case may not have died physically.

But a victim of brutal rape is going to 'die' psychologically every day. One cannot imagine the agony she is going through. In fact, for the parents of the victim, lives become meaningless after the incident. Their joy for life has been taken away.

India being a poor country does not have the resources for providing psychological counselling to victims of brutal crime. Hardly any man marries a rape victim there. India should not be simply copying every aspect of American law.

it isn't humanism towards barbarians, but concern about misapplication and conviction of guys who back out of live in arrangements or guys who piss someone off. that sort of thing. death penalty for rape sounds quite absolute to me. there were no ifs and buts clauses attached to the way jayalalitha stated it.

As someone who heads an institution for women, Nirmala Prasad, principal, M.O.P. Vaishnav College for Women, is constantly worried about safety. “Though we have over 100 CCTVs on the campus to make sure no man enters it without permission, the moment they step out, they experience harassment,” she said. Be it travelling by bus, or even while waiting for one, many students are victims of everyday abuse. We need stricter punishments for such people on roads and buses,” she said.

Sorry there can be no fool-proof laws in India. All laws are passed with good intention, and the "powers" start looking for loopholes and abuse. Expect ANY rape laws to be misused or abused - that too, by those politically connected.

JJ is not stupid, and I am sure the actual bill will look into other aspects. If anything our lawmakers look too much into framing these laws and take their own sweet time. Finally, when they are passed, some abuse takes place. Then ver 2 needs to be considered.
