SC has simply ruled on the existing Section 377 under the Indian Penal Code introduced during British Raj. The legislature can always repeal it, per SC.

377. Unnatural offences: Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for term which may extend to ten years, and shall also be liable to fine.
Explanation: Penetration is sufficient to constitute the carnal intercourse necessary to the offense described in this section.^[1]^[2]

The ambit of Section 377, which was devised to criminalize and prevent homosexual associations - sodomy in particular, extends to any sexual union involving penile insertion. Thus even consensual heterosexual acts such as fellatio and penetration may be a punishable offense under this law.

It is a penal code about the penile code of conduct.

What is shocking about Section 377 is that a husband who got a hard on while fast asleep and accidentally inserted it in the sleeping wife (regardless of where) could be sued by the wife and the law would find him guilty. Penile insertion is a bad thing in the eyes of the Indian law. But it is quite legal if the whole country is subjected to such insertion.

really, trying to have laws on sex is a waste of time and taxpayer money. it's a cultural thing how far one is willing to go, and what's the basis for calling homosexuality unnatural? that fact that some people seek intimacy or love with someone of their own gender and find such relationships satisfying is evidence that it is not unnatural, these are grown men and women who know what they want and we have to respect that and as long as they are not hurting anyone else I think it's nobody's business. what india needs is a law to prevent people from having more than 3 children per couple.

It is unlikely that any polical party, prior to the elections, will come out against section 377 asking for its repeal in the legislature.
