Giridhar C. Sekhar, 41, a former managing partner with Boston-based FA Technology Ventures, was convicted in April of attempted extortion for his failed blackmail of then-DiNapoli counsel Luke Bierman between Nov. 17 and Dec. 1, 2009.
Bierman, who left the comptroller's office last year, had recommended against granting the contract.
Sekhar of Brookline, Mass., sent Bierman six e-mails threatening to expose his alleged affair -- allegations a spokesman for DiNapoli's office has said were baseless.
"I know about your tryst with (the woman), and I have more than enough to prove it including messages and witnesses," Sekhar stated in a Nov. 18, 2009, e-mail. He gave Bierman two days to change his position.
If not, he warned, he would expose the alleged affair to Bierman's wife, DiNapoli and the media. He even invoked the notorious affair of golfer Tiger Woods, stating: "hope u had a great holiday. what do U think of that Tiger Woods story? who would have thought that a woman could get that upset ... and over what?"
Sekhar demanded the comptroller's office commit to the proposed $35 million investment in the New York State Common Retirement Fund by FA Technology Ventures. It would have given the company $8 million in fees.
The FBI and prosecutors tracing the e-mails to Sekhar's home computer. On Dec. 3, 2009, police in Brookline raided the home and discovered information about Bierman and his family in Sekhar's wallet. He was arrested, initially facing state coercion charges before being charged in U.S. District Court.
In court papers, Sekhar's attorneys, Kimberly Zimmer and William Dreyer, asked for no prison time. They noted Sekhar, a native of India who went to high school in Indiana, supports a wife battling a degenerative condition and two children.
