Do you think he can finish the inquiry before the new Govt is formed? If not, what is the point of this appointment that the new Govt can always turn down, if needed?

The idea is to create another obstacle for Modi to become PM. It would be embarrassing for Modi to try winding up a commission investigating him. Besides Cong could approach the Supreme Court to restrain Modi from winding up the commission investigating him.

If BJP manages to form the govt there is a good chance of Rajnath Singh becoming the PM.

If BJP gets 220+ seats by itself then no force is stopping Modi from becoming PM. And a new Govt can always re-define the terms of any commission as well as boot him out and it is well within the executive realm that the judiciary can do nothing. Modi is not the kind to be 'embarassed' with this anyways. Cong is better off concentrating how to restrict BJP to under 200 if they want to keep Modi out.

The person they are appointing is a sitting judge. Can he not invoke Contempt of Court, and threaten to put Modi in jail, if Modi tries to wind up his commission? I am sure Sibal, Khurshid, Singhvi et al have also thought this through.

New Govt. can strain funds and resources for the commission and as well as re-define the terms of inquiry. That itself will legally clip the wings and make the commission helpless and not deliver. Happened innumerable times earlier. It is just some gimmick being played by Cong bigwigs on the political theater. But this is not going to win them more votes, if they are hoping for that.

Usually these commissions are headed by retired judges who do not have powers of contempt of court, but because this is a sitting judge trying to curtail requisite funds or trying to narrow the scope of enquiry is liable for contempt of court powers to be invoked.

If the appointee is a sitting judge, his boss (CJI of Allahabad HC or SC) has to clear his name. They can reject the appointment without giving reasons.

In the end, this move will backfire on CONmen. Even Muslims will be sick of the recent CONgames.

This is an interesting article on this issue:

Rashmunullah's political knowledge is often laughable. If Madam Singh and MT Sonia can dodge 2G, Bofors, Vadra gate for years and years killing snoopgate is like simple sneezing for Modi.

Congress is really worried about all its scadals and VADRA.
