BJP leader Babulal Gaur: 'Rape is sometimes right, and sometimes wrong'
Babulal Gaur, home minister in the BJP government of Madhya Pradesh, on Thursday defended Uttar Pradesh Chief Minister Akhilesh Yadav and his father, Samajwadi Party chief Mulayam Singh Yadav over the Badaun rape case.
Calling the Samajwadi Party supremo and Uttar Pradesh's chief minister as "bechare (helpless)", Gaur said: "What can Mulayam and Akhilesh do (to prevent rapes)?"
Talking to reporters, Gaur said that "rapes happen when a man loses his mental balance". Gaur described rape as a social crime, saying "sometimes it's right, sometimes it's wrong."
"This is a social crime which depends on men and women. Sometimes it's right, sometimes it's wrong," said Gaur, the home minister responsible for law and order in BJP-run Madhya Pradesh. "Until there's a complaint, nothing can happen," Gaur told reporters.

May be his logic goes thus. 'It is right for the perpetrator and wrong for the victim' => on the whole it is okay being right sometimes and wrong sometimes.

no. i think his logic is that sometimes cases of rape might be cases of consensual sex. because things didn't work out in the relationship somehow the women got their revenge on the men by crying 'rape'. on other occasions, it might be that the woman has not even had consensual sex but starts crying 'rape' because she wants to make life difficult for the man for some reason or another.
i once read a short story about an umarried middle aged unattractive woman who for some reason that i now forget was in a secluded room together with a handsome young man. the woman started shouting loudly and when other people came by she accused the young man of attempting to rape her. her motivation was that she wanted to indicate to others that this handsome man found her attractive--it was her way to boost her self-esteem. i also read an erle stanley gardner story in which the woman is a professional in that she tears up her own clothes, bruises herself, and accuses a man in proximity to her of attempting to rape her. when the cops come they arrest the man--sometimes the guy is kept behind bars for several years. i forget now why the woman was doing this to the men.

needless to say, it would be rare for any woman to accuse a man falsely of rape. Particularly so in India given the stigma of rape or even molestation. Of the two cases from fiction that i mentioned, the first was from a story based somewhere in malaysia and the second in the US.

He did not say Rape of WOMEN is right. Rape of men is right (hallalujah..) and rape of women is wrong....
Didn't the SC rule recently that there is no "rape" within a marital setting? Does it mean Rape within a marriage is right and rape outside of marriage is wrong?
Besides, the stupid Indian laws REQUIRE a victim to file a FIR before any action can be taken. The criminals then threaten the victims not to file or withdraw the FIR.
This is absurd. In the US, once filed you cannot withdraw. Also, any public defendent can file on behalf of the victim.
Time to dump archaic rules and procedures in the judiciary - as Modi ji said yesterday...
