Hello,



Can you please help me with these three



Earlier you had to apply for and get approved for H1B visa on or
before April 1. Once approved you could start working only on October 1.
I heard somewhere that now that rule has changed, you can basically
start working ANY time of the year as you can apply for the visa anytime
of the year (not withing this April1 deadline). Can someone please
confirm if this is true, not much information is available on the USCIS
website.





Next question is that if I apply to a US company while sitting in
India (I have no H1B visa at it expired), and I work as a freelancer for
a US company sitting in India, then do the rules of H1 B Visa apply to
me? Can I legally get my salary paid to me in USD while I sit at home
and work in India?



Final question, when you guys return back to India, how do you
calculate your market worth? You obvoulsey can not simply convert USD to
INR, so then how do you now what your CTC to an Indian company would
be?

The rules haven't changed. Start dates for application and for working remain the same. However, there is not much demand for H1B these days, so the visa is available for 8-9 months through the year whereas the entire quota used to get filled up with a week or so earlier. Last year, the 65K quota got filled only in January.

Logically, if you're not in the US and are not holding a H1B visa, the visa rules don't apply. Was there any specific rule you had in mind? Yes, you can get paid in USD if you have a SSN and a bank account in the US, but your employer would have to deduct withholding taxes from your salary and in addition, you are liable for taxes in India (as a resident) on this overseas income.

If you work for an Indian company, your INR salary will also be growing during your overseas stint, with annual increments etc. So you have the option of continuing in the same company at a "marked to market" salary on returning. Of course, the most accurate mark to market is to simply float your resume in India while still overseas, see how many bite and how much they're willing to pay.

Thank you for the detailed response to my questions.

Regarding your first answer, so if I find a job in the US 'now' and am
willing to start working in a few months time, lets say by next month- I
simply can not do it because I missed the April1 deadline? As in, since
I did not get a job and had visa papers in order by April 1 2012, the
earliest I can start working is October 2013?? Wow that seems
unbelievable!

Regarding your second question, yes I had a specific rule in mind. As
you know an H1B is given for a total of 6 yrs, so if I work for a US
company as a freelancer sitting in India, then will 'this time' with my
company count towards those 6 yrs? Another scenario is this: once one
has exhausted all 6 years of the H1B (and not got their GC done and
returned to India), one is eligible for a fresh 6-yr H1B, if one has
spent 365 days out of the country. So now if during this 1yr out-of-US
wait period, if I work for a USA company sitting in India, am I
infringing any visa rules that will prevent me from entering the US
again on a fresh H1B one year later?

Third, I am floating my resume in India, but they are the ones who ask
for a CTC, and I don't want to sound like I am at sea when I talk to
them- as if they pick on it, they will perhaps offer me the least
possible they can as they will recognise that I know nothing about
salaries so may not be able to negotiate. (BTW the companies I work for
in the US are not the same as in India)

Along the same lines I have another question, how to people who return
back to India feel about their salaries, like a software guy who is
starting off, is fresh out of school may will 60 K USD PA. Now if you
convert it to IND that 30 Lac p/A. No fresher gets that salary in
India. I guess that is the biggest culture shock on returning to India.

I think you misunderstood my response. April 1st is not a deadline. It's just the start date for accepting H1B applications. You can apply now and if your petition is approved, get the visa stamped and travel to the US after Oct 1, 2012.

No. You don't need a visa to sit in India and work for somebody in the US. The 6-year rule applies only after you actually apply for a H1B and from the time you your petition gets approved.

Just ask your peers or post the query on some specialized website with details of your experience and skills.

It's silly to just look at the headline number without looking at the costs. Just as your INR salary might be lower than the USD salary converted into rupees, so also your costs. It's the quality of life and potential for net savings that you need to look at.

The rules hasn't changed. It is the fiscal year 2013 which means (from oct 2012 -oct 2013) infact the year starts early for H1b visas. The dead line to accept applications is by April 2012 and once approved you can start working from oct 2012. There is a ton of information available on the uscis web - they have changed the web address - please google or bing it.

You don't need visa to work from India. Visa is needed only when your work demands to work in US. You can still get paid without Visa from your employer. Legally you get paid in the local currency and the employer don't have to meet the US salary standards and other medical insurance and benefits. You can ask your employer for more details.

I don't think anyone returning will expect to be paid in USD while working in India. They will have to follow Indian salary standards and pay scale to determine the CTC.

"Being physically present in the US" and "working for a US company" are two very separate things. Visa rules apply only for the case of being physically present in the US. You can live in India and work for an American company's Indian subsidiary; that's the whole basis of offshoring and that does NOT require a visa. Unless you enter the US, that six-year clock does not start ticking, AFAIK. Even after the clock runs out at six years, if your employer files for your permanent residency, you can obtain one-year extensions as long as that application for permanent residency is being evaluated by the US government.

BTW Sasthi as merot daruwala explained, april 1 is 'not' a deadline like you mentioned. Most people are confused about this one, like myself.

Is there a website where one can find out if the 65K limit for this year has been filled or not? TIA

Thanks, actually what if that company does not have an Indian subsidiary? I am thinking of working as a "freelancer" or a "consultant" for a US company that may or may not have a subsidiary in India. tia

Lady....for someone who is sitting at home you have way too many questions. I can answer only one question.

You are worth whatever offer comes along. What are you going to todo? Decline an offer that is 20K less than your "Market rate" of 70K?

If you are unemployed with a few hundred dollars in your bank account and faced with a deportation noice in your hand, you will sink into some reality.

Incidentally, if you SIT in India and freelance for an American company, here is what can happen. You will put on weight, become prone to type 2 diabetes, hypertension and depression. Your parents will have tough time finding matches for you. You will end up being on Facebook, Twitter and interesting sites that Karnataka MLAs visit. Raj Thakarey, Sibel or Mamata will tell the cops to put you in jail.....
