மதம் மாறி திருமணம் செய்து கொண்டதாலேயே கணவரின் ஜாதி அந்தஸ்தை தனக்கும் வழங்குமாறு பெண் கோர முடியாது என்று சென்னை உயர் நீதிமன்றம் கூறியுள்ளது.

இது தொடர்பாக ஏ. பாத்திமா என்பவர் உயர் நீதிமன்றத்தில் மனு தாக்கல் செய்திருந்தார். இந்து மதம் செங்குந்தர் ஜாதியைச் சேர்ந்த நான் இஸ்லாமிய மதத்துக்கு மாறி, அந்த மதத்தைச் சேர்ந்த முகமது ஆசாத் என்பவரை கடந்த 2006-ம் ஆண்டு திருமணம் செய்து கொண்டேன். பிரேமாவதி என்ற எனது பெயரையும் பாத்திமா என மாற்றிக் கொண்டேன். எனது கணவரின் ஜாதியான பிற்படுத்தப்பட்டவர் (முஸ்லிம்) லப்பை என்ற ஜாதி சான்றிதழை எனக்கு வழங்கிடுமாறு கோரி நான் அளித்த விண்ணப்பத்தை பரிசீலித்த காஞ்சிபுரம் வட்ட தலைமையிடத்து துணை வட்டாட்சியர் அதேபோல் சான்றிதழும் அளித்துள்ளார்.

இந்நிலையில் ஊரக வளர்ச்சித் துறையில் உதவியாளர் பணிக்காக டி.என்.பி.எஸ்.சி. நடத்திய தேர்வில் நான் கலந்து கொண்டேன். ஆனால் பிற்படுத்தப்பட்டவர் (முஸ்லிம்) பிரிவில் என்னை சேர்க்காமல், பெண்கள் - இதரர் என்ற பிரிவில் டி.என்.பி.எஸ்.சி. சேர்த்துள்ளது. இதனால் நான் பாதிக்கப்பட்டுள்ளேன்.

ஆகவே, பிற்படுத்தப்பட்டவர் (முஸ்லிம்) என்ற பிரிவில் என்னை சேர்த்து, எனக்கு பணி வாய்ப்பு வழங்கிடுமாறு டி.என்.பி.எஸ்.சி.க்கு நீதிமன்றம் உத்தரவிட வேண்டும் என்று அந்த மனுவில் பாத்திமா கோரியிருந்தார்.

இந்த வழக்கை விசாரித்த நீதிபதி கே. சந்துரு மனுவை தள்ளுபடி செய்து அண்மையில் உத்தரவிட்டார். பிறப்பால் அல்லாமல், இஸ்லாமிய மதத்தைச் சேர்ந்தவரை மதம் மாறி திருணம் செய்து கொண்ட ஒரே காரணத்துக்காக தனது கணவரின் ஜாதி அந்தஸ்தை தனக்கும் வழங்க வேண்டும் என்று மனுதாரர் கோருகிறார். ஆனால் திருமணம் காரணமாக ஒருவர் தனது ஜாதியை மாற்றுமாறு கோர முடியாது. இதை ஏற்கெனவே உச்ச நீதிமன்றமும் உறுதிப்படுத்தியுள்ளது. ஆகவே, மனுதாரருக்கு பிற்படுத்தப்பட்டவர் (முஸ்லிம்) லப்பை என்று அளிக்கப்பட்ட ஜாதி சான்றிதழ் செல்லாது என்று நீதிபதி தனது தீர்ப்பில் கூறியுள்ளார்.

For those who don't understand Tamil, and curious, in a nutshell:

Premavathy, a Hindu lady who is from sengunthar caste (assume it's a FC?), fell in love with Mohammed who is a Muslim, and from labbai BC (Backward caste) converted to Islam changed her name to Fathima..she got a "certificate of religion- caste conversion" from some Govt. office..but her employer refused to accept the certificate for ? a job promotion and she petitioned the court to change her caste based on the marriage/religious conversion. The lower court rejected her request and the HC did the same.

*So basically one is stuck with the caste of their birth, even if they convert and want to be classified as backward (talk about irony!) But, I agree with the Court/Judges..forget marrying for lust, I mean love and converting (even if one is sincere) is one thing..this seems like blatant exploitation of the system.

Not a fair judgement. The court should encourage inter caste marriages by giving benefits to the convertees; that's the purpose of having caste based reserves! If she gets the job the entire family gets the benefits. At least women should get benefits with these kinda arrangements. The hindu judge seems to be mad that a hindu girl is married into a muslim family.

The plaintiff is missing a point. Per law and iSlam, there are no CASTE categorization. But, in reality, they inherited the hindu caste system. I am quite sure Sengundhars are FC - the warrior class.

In my view, no one in islam is backward. They were rulers for a 1000 years, and hence not backward. The OBC, SC/ST are given quota bcz they were oppressed historically. But, the muslims were NOT oppressed, and contrary ot that were rulers and oppressors.

They are poor NOW, but sorry no dice...that is bcz they chose to stay behind even after being given a country they wanted. If anything they should blame pakistan for closing the door on them. They should protest to the UN to open Pakis doors to them.
