"In a new twist, it has now emerged that senior Indian diplomat Devyani Khobragade enjoyed full diplomatic immunity including from personal arrest and detention on December 12 when she was taken into custody by the US authorities in a visa fraud case.

39-year-old Khobragade, who was posted as Deputy Consul General in New York, was also accredited as an "Advisor to the Permanent Mission of India to the United Nations" by the UN w.e.f. 26th August 2013 and her status as an Advisor was valid until 31 December 2013. The accreditation was for the UN General Assembly 2013. "

If this information is true, how will Usa govt walk back its treatment of dk?
one suggestion is to send bharara for a diplomatic trip to afghanisthan and strip his immunity upon landing in afghanisthan. He can then be strip searched by Khan and cavity searched by sheikh.

If the information is true, the Indian Government would not be trying to move her to the UN to get 'full diplomatic immunity' in the first place. And they would have argued this right at the beginning rather than splitting hairs on consular immunity.

I agree that this is not an accurate assessment. In addition what matters is what is in state Dept file. If this is some paper error, I.e. dk is fully eligible but somehow did not communicate to the state dept, it is still Indian problem.

Just for argument sake assume dk got eligibility for immunity, then she can get off the criminal case based on Florida case of Saudi prince, 198??.

Exactly...

If Devyani did not even know she had UN immunity from August and did not even use it during her interrogation, then she should be dismissed from IFS. If she cannot argue in her own favor sitting in a powerful position and with supposed immunity, how will sge represent other common Indians?

How come the ambassador, the MEA and others did not know this until now...and the fact that they "applied for a transfer to UN" indicates the efficiency of the Babus.

i spoke to my folks back in india about this. they don't have an iota of sympathy for this woman and are in fact happy that she got nailed in this scandal in the US after having dodged the law for such a long time in india. for all the indian media's hysterical reporting and attitude about the US govt on this issue, the people are by no means united in their response.
