Devyani Khobragade agrees to waive indictment deadline
"The crisis surrounding the case of the Indian consular official whose arrest last month sent U.S.-India relations into a tailspin was at least temporarily cooled late Monday when the diplomat agreed to waive a Jan. 13 deadline to indict her.
Although several people close to the case would not cite any specific steps toward resolution, the postponement could ease pressure on the State Department, which has been at odds with federal prosecutors over the wisdom of the arrest and how it was conducted. Only the defense can waive the right to be indicted within 30 days from the date of arrest.

Preet Bharara does not agree to waive the deadline. So sad!

He is either being a big drama queen or playing a dangerous game by putting American diplomats in India in jeopardy. My hunch is he ultimately is going to cave in, just putting a brave face on.Hellsangel wrote:Preet Bharara does not agree to waive the deadline. Indian Govt. should stop pussyfooting, grow a pair and lock up that gay couple and have an interpol notice served to ShareKhan for interfering & whisking away accused family from ongoing legal proceedings then this issue will be miraculously resolved in a day, there is a good chance that all the conservative crowd might become India's biggest fans and may start cheer leading for India.

Wishful thinking or frustration, Comrade CD, that you are going against your own values?

Someone should investigate whether Preet Bharara's parents lied on their visa applications.

I know it is wishful thinking but the reality is every Tom, Dick and Harry knows America is a self-imploding superpower, they can't afford another war against meek B'desh let alone India should they lock up a couple of diplomats; India should take advantage of it rather than tiptoeing around the issue under the garb of matured diplomacy or whatever crap. What values are you trying to shove in my mouth now? I may not have anything against same-sex marriages but never cozied up to the idea I thought I made it clear to you a few months ago.Hellsangel wrote:confuzzled dude wrote:

It looks like a conflict between state dept and judiciary is holding up the settlement. another issue is on Indian side devyani wants to be back in usa after settlement and mea is not willing to support that all the way.
for now Indian govt will keep the issue alive for electoral reasons. after.may 14 mea honchos will cut a deal and let devyani find her own way.

Re: Devyani Khobragade agrees to waive indictment deadline
Devyani does not seem to understand the dynamics.
here are some pieces of information provided by Indian express
a. devyani wants the right to come to usa in future
b. devyani is ready to agree to criminal culpability if no jail time was involved.
c. mea does not want criminal culpability for fear of future impact on other diplomats.
d. mea is not so keen on devyani desire to return to usa later. They plan to move her to un get immunity and get her out of usa after few months.
e. it looks like state dept took the lead in going after devyani after she approached them.
f. issue became a tough nut with judiciary involvement.

It seems her hubby is a U.S citizen. That is what's behind her wish to come back to America. But a convicted felon is not allowed in.

Q: Can the US drop this case as India has demanded?
A: According some legal experts, the US can drop the charges at this stage. Once the charges are formally registered, even the White House can't save her. According to former foreign secretary of India Kanwal Sibal, charges can be dropped only before mid-January. Like in India, judiciary is independent also in the US. Government can't dictate terms to the judiciary

Mea should keep the discussion in cold freeze till after Indian elections. then they should.choose a deal in national interest. devyani should decide on her future. she cannot have cake and eat it too. in fact.she.cannot have.cake. she has no option but to abandon usa dream.

Re: Devyani Khobragade agrees to waive indictment deadline
Devyani Khobragade, India’s deputy consul general in New York, was recently arrested for visa fraud- allegedly paying her housekeeper Sangeeta a mere $3.31 per hour (instead of the $9.75 required under US law), and lying to the US officials about Sangeeta’s real wage and working conditions. In fact, the official complaint alleges that Sangeeta was working “far more than 40 hours per week,” making her wage even less than $3.31. More details of the case involving threats to Sangeeta’s family have emerged since the arrest. While the arrest has sparked a diplomatic row between the US and India, with justifiable concerns about Khobragade’s treatment upon arrest at the center, we must not lose sight of the serious criminal allegations of fraud and worker exploitation. India is trying to shield Khobragade from the consequences of her actions -- making sure Sangeeta never gets a day in court. Tell Secretary Kerry and President Obama that no one should get a “free pass” for violating human rights in the United States.
Here at the National Domestic Workers Alliance (NDWA), we help thousands of women like Sangeeta who have suffered exploitation and abuse, had their wages stolen, and struggled to achieve basic workplace protections. Today we #StandWithSangeeta and ask you to join us.
The Indian government is trying to deny Sangeeta her day in court, her chance for justice. They are claiming Khobragade had “diplomatic immunity” when she was arrested, and thus cannot be brought to trial. Even worse, instead of asking her to take responsibility for her actions, they are rewarding her with a position in the UN, which they say would solidify her immunity. Diplomatic immunity is a privilege that should not be used as a shield against criminal prosecution for private acts, and the US has the power to decide whether or not to grant her request for reaccreditation to the UN.
Dozens of cases of labor exploitation and human trafficking at the hands of Diplomats have made headlines over the years. Allowing Khobragade to hide behind immunity could undermine a decade of progress in fighting against this kind of abuse.
The United States should refuse to give Khobragade a “free pass” for exploitation. We are asking them to:
- Deny Khobragade’s reaccreditation to the United Nations
- Continue the federal criminal prosecution against her
- Continue to enforce the important regulations that protect Sangeeta and the hundreds of other domestic workers who come to the US with diplomats and international officials from all over the world.
Join us as we #StandWithSangeeta and ask the U.S. government to hold diplomats accountable for labor exploitation.
