The first circuit Court of Appeals in Boston has ruled the federal Defense of Marriage Act that Clinton signed in the '90s unconstitutional. The law prevents legally-married same-sex spouses of federal employees from receiving benefits that they would otherwise be entitled to. Opponents of same-sex marriage are usually advocates of states rights as well. But when it comes to same-sex marriage, they want to get the federal government involved in matters of state law, refusing to recognize the states' power to legislate on marriage issues. If the citizens of a state have passed a law that confers equal legal status on same-sex marriages, there is no constitutional basis for the federal government to refuse benefits to the spouses of such employees of the federal government. I am happy that the court has thrown out this blatantly discriminatory law. I hope the United States Supreme Court agrees with the appeals court.

The second circuit Court of Appeals in New York agrees with the first circuit in ruling DOMA unconstitutional. The Supreme Court will hear the case this term and issue a ruling in 2013. I hope they strike down this flagrant violation of the equal protection clause.
