That Apple has not chosen to go after that forum does nothing to affect Sulekha's rights adversely, were they to choose to press their copyright claims. It's like if two landlords have houses, and both are occupied illegally. If the first landlord chooses not to seek legal recourse, that does not mean the second landlord's case is weakened.
