Why do Hindia not want to gazette 2007 Cauvery Award?
Why do Hindia not want to gazette 2007 Cauvery Award?
They should have done that immediately and end the dispute. Did not do it. Then Jayalaslitha filed a petition with Supreme court as soon as she came to power in 2011.
Supreme Court chastised Hindian gov and Hindia promised to gazette it by Dec 31, 2012. Did not do so. SC scolded it and Hindia promised to do so by Jan 31, 2013. S few days ago SC told Hindis that it is flouting the law for years and it has no other option and must notify by Feb 20, 2013.

The reason is simple. Congress does not want to strengthen BJP's grip in Karnataka by taking sides with the aggrieved parties, namely TN, Kerala and Puducheri. It has strategically danced around making a unilateral decision since 2007 and instead has asked for the aggrieved parties to reach a consensus on their own (which is bullshit). Already Mr. Gowda is appealing to Dr. Manmohan Singh saying that the award itself is fundamentally flawed and that Karnataka will be deprived of drinking water once the award is gazetted (which is also bullshit). Keep in mind that the award can only be granted with the Cabinet's consent.
Seconly, even if the award is published in the government gazette as mandated by the Supreme Court, "it shall be without prejudice to the pending proceedings" meaning that the Supreme Court and the Cauvery Water Dispute Tribunal will continue to hear the petitions filed.
So nothing is written in stone yet. At best the mandate is etched on warm butter.

Here's one more tidbit for you. Keep in mind that the last trips to Delhi by MK of DMK were to meet with his daughter Kanimozhi and his partisan A. Raja both in prison. The Cauvery issue was just water over the dam for him (pun intended).
Meanwhile Arch rivals DMK and ruling AIADMK in Tamil Nadu on Tuesday verbally jousted in taking credit for the Supreme Court’s directive to the Central Government to notify the Cauvery Tribunal’s final award in the gazette by February 20, even as most political parties complimented Chief Minister J Jayalalitha for her "sustained efforts".

Here is the reason. Hindians want to keep Tamils and Kannadigas at each others throat. This way Kannadigas spend their energy squabbling with Tamils, they won't bothyer with Hindi imposition. Actually there is strong anti-Hindi feelings in Karnataka but they spend more time quarelling with TN.
Also once the award is notified, Indian gov has no role in making decisions on water dispute. That is Hindians don't have any power on Cauvery water. All decisions will be made by the tribunal.
The pending court cases/appeals will go on. They are about interim water sharing, not about the final longterm sharing. Once the pending cases are rules, no more law suits. The 2007 award will be implemented as it is.

The Center will come into play since the PM is the chairman of the tribunal. Besides, the pending petitions from Karnataka have to be dealt with by the apex court which do involve the sharing of water. This whole dispute dates back even to the times of Madras Presidency and the Princely State of Mysore so it is not going to end once the award is gazetted.
At least I am glad you are more optimistic than I am.

Actually you are mixing between Cauvery River Authority (CRA) and Cauvery Water Dispute Tribunal (CWDT). PM is the chairman of CRA. THere is no politician in CWDT. The CWDT award is final. Once the award is gazetted, CRA will no longer exist and politicians will not have any role. Hindi politicians would have no say except in appointing the next chairman of CWDT. Other than that, politicians have no say.

I meant CRA. Also, the cabinet approval to the award is still pending. Once CWDT gazettes the award on the 20th, the way I understand it, the implementation of it over the next 3 months will be done by Cauvery Management Board (CMB) consisting of senior officials from the Ministry of Water Resources. Meanwhile there have been numerous petitions challenging the award which legally must be heard by the Supreme Court and the Tribunal. It is not as cut and right as you think. There can be many a slip between the cup and the lip. Let us review this 3 months later and see if things unfold the way you assert. Deal?
